1. Overview
These Notification Terms and Conditions ("Notification Terms") govern the use of messaging and alert features within the software application provided in connection with the MCS Smart Platinum Insect Misting System (the "System"). By installing or using the application, the "User" agrees to these Notification Terms as part of the End User License Agreement (EULA).
2. Purpose of Notifications
The application provides optional notifications intended to inform users of operational alarms and system status events related to their MCS Products Smart Platinum Insect Misting System. Notifications are designed for convenience and situational awareness only and are not a substitute for regular system monitoring, inspection, or maintenance.
3. Types of Notifications
Depending on user preferences and device capabilities, notifications may be delivered via:
- SMS (text message)
- Mobile push notifications
Users may enable, disable, or modify notification preferences within the application settings where available.
4. Examples of Alarm Notifications
Notifications may include, but are not limited to, the following alarm types:
- Alarm - MCS System - Barrel Fluid Level Low
- Alarm - MCS System - High Flow Detected
- Alarm - MCS System - Low Flow Detected
- Alarm - MCS System - Maintenance Required, Call your MCS Technician
Notification wording may vary over time as features evolve.
5. No Guarantee of Delivery
MCS Products and its affiliates do not guarantee that notifications will be sent, delivered, received, or viewed in real time or at all. Delivery may be affected by factors outside our control, including but not limited to:
- Internet connectivity issues
- Mobile carrier limitations or filtering
- Device settings or operating system restrictions
- Email spam filtering
- Third-party service outages
6. User Responsibility
By enabling notifications, you agree that:
- You are responsible for maintaining accurate contact information (email address, phone number, and device permissions).
- You will ensure your device settings allow receipt of notifications.
- You will not rely solely on notifications for safety, compliance, pest control effectiveness, or equipment protection.
- You will promptly investigate alarms and contact a qualified technician when appropriate.
7. SMS and Messaging Consent
If the user enable SMS notifications, you expressly consent to receive automated text messages related to System alarms and status updates. Standard message and data rates may apply based on user's mobile carrier plan. Users are responsible for all such charges.
Users may opt out of SMS notifications at any time through the application settings provided or by discontinuing use of the notification feature via STOP message.
8. Third-Party Services
Notification delivery may rely on third-party providers (such as mobile carriers, email services, or push notification platforms). MCS Products is not responsible for failures, delays, or inaccuracies caused by third-party services.
9. Not a Safety System
The MCS Smart Platinum Insect Misting System and associated notifications are not classified as life-safety systems. Notifications are informational only and must not be relied upon as the sole means of preventing property damage, pest exposure, equipment failure, or other risks.
10. Modifications
MCS Products reserves the right to modify, suspend, or discontinue notification features at any time, with or without notice, including changes to notification content, frequency, or delivery methods.
11. Limitation of Liability
To the maximum extent permitted by law, MCS Products shall not be liable for any damages, losses, or claims arising from:
- Missed or delayed notifications
- Inaccurate or incomplete alerts
- User reliance on notifications
- Failure to act on notifications
- Communication failures beyond our control
12. Acceptance
By installing, accessing, or using the application, the user acknowledges they have read, understood, and agree to these Notification Terms as part of the EULA governing the MCS Smart Platinum Insect Misting System.
